LCM DIGITAL-PRIVACY POLICY APP

If you use the LCM Digital Platform as an LCM Digital Web Application at https:\\www.lcmdigital.com ("Web Application") or as a mobile LCM Digital App ("App") (both together the "LCM Digital Platform") as an LCM Digital client, administrator of an LCM Digital client ("Administrator") or other end user of an LCM Digital client ("End User"), LCM Digital GmbH in the course of formation will process certain personal data. LCM Digital processes personal data of LCM Digital clients, the administrators and end users in particular to provide the App to LCM Digital clients, including their administrators, the LCM Digital platform and end users and to manage the client relationship.

The data processing by LCM Digital generally takes place within the EU. If the data processing takes place outside the EU or the EEA, LCM Digital shall ensure an adequate level of data protection at the place of the data processing. LCM Digital will only pass on the processed data of LCM Digital clients, administrators and end users to third parties in the cases mentioned in paragraph 3 of the long version of the LCM Digital Privacy Policy.

If you use the web application as part of the account of a LCM Digital client who has provided you with access to his account, the respective LCM Digital client will process certain personal data. Information on the processing of personal data when using the functionalities of the web application can be found in the data protection agreement of the respective LCM Digital client, which you can find under the heading "Data protection agreement for end users".

In this Privacy Policy ("LCM Digital Privacy Policy"), LCM Digital explains how LCM Digital processes personal data from LCM Digital clients, administrators of a LCM Digital client and other end users of LCM Digital clients on the LCM Digital platform as an LCM Digital web application at https:\\www.lcmdigital.com ("Web Application") or as a mobile LCM Digital App ("App") (both together the "LCM Digital Platform").

The extent of data processing by LCM Digital depends on the role in which you use the LCM Digital Platform, i.e. as:

  • LCM Digital client who has ordered a client account for the LCM Digital platform from LCM Digital ("LCM Digital Client");
  • Administrator of a LCM Digital Client ("Administrator") who manages the Client Account in the Web Application and/or allows End Users to access certain functionalities of the Web Application within the scope of the Client Account ("Administrator Activities"); or
  • End user of an LCM Digital client to whom an LCM Digital client has provided access to his client account ("end user"), who enters project data via the functionalities of the LCM Digital platform in the web application or app, exports overall process analyses, process planning, action lists and takt analyses, or scans job cards using the app ("use of platform functionalities"). If an administrator uses the platform functionalities like an end user, e.g. carries out process planning, the following information also applies to administrators when using the platform functionalities.

LCM Digital GmbH in the course of formation, Bundesallee 39-40a, 10717 Berlin, Germany ("LCM Digital" or "we") is responsible for the processing of Personal Data within the meaning of the EU General Data Protection Regulation ("GDPR"):

  • LCM Digital client in connection with the LCM Digital platform;
  • Administrators in connection with their administrator activities in the web application;
  • Administrators, in connection with their use of the platform functionality in the app; and
  • End users in connection with their use of the platform functionalities in the App.

For the use of the platform functionalities of the web application as end user (including administrators) the respective LCM Digital client processes certain personal data. Information on the processing of personal data of end users, including administrators, when using the platform functionalities of the web application can be found in the data protection declaration of the respective LCM Digital client, which you can find in the "Data protection agreement for end users".

2. Processing of Personal Data
2.1 Personal Data

"Personal data” means any information relating to an identified or identifiable natural person (Article 4(1) GDPR).

This includes in particular the first name, surname, title, company, state, e-mail address, country, city, date of birth, telephone number, mobile number, password and preferred language as well as all other registration and order form data that the LCM Digital client, administrator or end user communicates to LCM Digital when registering or ordering services relating to the LCM Digital platform ("Personal Data").

2.2 Processing of Personal Data

"Processing" is among other things each collection and recording, the organization, the arrangement, the storage, the adjustment or modification, the readout, the request, the use, the disclosure of personal data (article 4 No. 2 GDPR).

Partly the processing of the personal data of LCM digital clients, administrators and end users is necessary in order to operate the LCM digital platform or to administer the client relationship. Other personal data Processed by LCM Digital on the basis of legitimate interests.

Specifically, LCM Digital processes the following categories of Personal Data for the following purposes:

2.2.1 Registration on the LCM Digital Platform

Doesn't apply to the app.

When administrators of LCM Digital clients register in the Web Application, LCM Digital processes their first name, last name, title, image, company, state, email address, country, city, date of birth, telephone number, mobile number, address, password and preferred language entered by the administrator in the registration form ("Registration Data") for the purpose of registration, i.e., creating the account on the Web Application and accessing the account of the LCM Digital client.

The legal basis for the processing is Article 6(1) lit. f GDPR, our legitimate interest in fulfilling our agreement to provide the LCM Digital platform to our LCM Digital clients.

2.2.2 Operating the LCM Digital Platform

To provide the Web application to LCM Digital clients and their administrators and to provide the app to LCM Digital clients, their administrators and end users, LCM Digital processes the registration data of the administrators and end users.

The legal basis for the processing is Article 6(1) lit. f GDPR, our legitimate interest in fulfilling our agreement to provide the LCM Digital platform to our LCM Digital clients.

2.2.3 IT-security

In order to ensure the secure operation of the LCM Digital platform, LCM Digital uses log files to process information such as which browser the LCM Digital client or its administrators and end users use when visiting the LCM Digital platform, their login activities and the IP addresses used.

The legal basis for the processing is Article 6(1) lit. f GDPR, our legitimate interest in fulfilling our agreement to provide the LCM Digital platform to our LCM Digital clients.

2.2.4 Administration of the client relationship

Doesn't apply to the app.

LCM Digital processes the following personal data of LCM Digital clients for the administration of the client relationship (e.g. processing of the order of services regarding the LCM Digital platform or invoicing): Main contact person and their position, billing contact person and their position, company name, address, email address and other personal data that LCM Digital clients enter on the order form.

The legal basis for the processing is article 6(1) lit. b GDPR, the contract fulfilment.

2.2.5 Email notifications and push messages within the app

In addition, LCM Digital processes the registration data of LCM Digital clients or their administrators and the data that LCM Digital clients have entered in an order form in order to provide LCM Digital clients and their administrators with information (e.g. information about new functionalities or to manage the client relationship) as part of the provision of the web application. In addition, LCM Digital processes the registration data of end users in order to provide them with information (e.g., information about new functionalities) as part of the provision of the app.

The legal basis for the processing of these personal data of the LCM digital clients is article 6(1) lit. b GDPR, the contract fulfilment. The legal basis for the processing of these Personal Data of Administrators and End Users is our legitimate interest in providing our clients with an up-to-date and functioning LCM Digital Platform, which from time to time may require communication with Administrators and End Users.

2.2.6 Optimizing the LCM Digital Platform

LCM Digital is constantly striving to improve the LCM Digital platform. Therefore, LCM Digital processes personal data from LCM Digital clients and administrators when they use the Web application and from end users when they use the app in the form of anonymous metadata.

The legal basis for the processing is the legitimate interest of LCM Digital to provide a content relevant and user-friendly LCM digital platform (Article 6(1) lit. f GDPR).

2.2.7 Uploading content via the App

End users, including administrators, can enter, create and upload content (e.g. job cards or photos) containing their own personal data into the respective client account of the LCM digital platform via the app within the scope of the functionalities contained therein, via free text fields and upload options. LCM Digital Processes this Personal Data to provide it to its clients and their administrators and end users for viewing, further processing and analysis in the web application.

Users are prohibited from uploading content that contains personally identifiable information about others.

The legal basis for the processing of an end user's own personal data that has been uploaded, created or uploaded is Article 6(1) lit. f GDPR, our legitimate interest in providing our clients with the LCM digital platform including the app functionalities.

The legal basis for the processing of the Personal Data that End Users or Administrators have entered, created or uploaded via third party End Users is the legitimate interest of LCM Digital to make the functionality of the App available to all End Users of the respective LCM Digital Client (Article 6(1) lit. f GDPR). The interests of the end users concerned do not oppose this, since they have accepted the terms of use for the respective client account of the LCM digital platform. These Terms of Use describe the communication and collaboration functionalities of the LCM Digital Platform that are necessary for the contractual functioning of the client account of the LCM Digital Platform; by accepting these Terms of Use, the respective end user undertakes not to create, post or upload any content that infringes personal rights.

2.2.8 Scan-Function

End users, including administrators, can make use of the app to scan barcodes on job cards. The app requires access to the camera of the end user's or administrator's mobile device.

LCM Digital processes the following personal data: the photographed barcode, the personal website content or other content behind or linked to the barcode.

The end user is explicitly asked whether the app is allowed to access the aforementioned functions and data. The App uses these functions and data only with the consent of the end user. In the settings of the app and the settings of his mobile device, the end user can revoke his consent at any time.

The legal basis for the processing of the own personal data of an end user, which have been uploaded, stored or uploaded and which have been set up, created or created via the scan function, is Article 6(1) lit. a GDPR, the consent of this end user.

3. How long does LCM Digital store this Personal Information?

LCM Digital Processes the Personal Data described in paragraph 2 for the purposes described above, as well as to comply with statutory retention requirements or to defend against or enforce legal claims.

4. How does LCM Digital share this Personal Information with third parties?

Personal data of LCM Digital clients, their administrators and end users will only be shared with third parties in the following cases:

LCM Digital uses external and independent service providers (e.g., cloud or hosting providers) to help LCM Digital operate the LCM Digital platform. LCM Digital has carefully selected these service providers and, to the extent required by law, has entered into so-called order processing agreements. LCM Digital transmits the data in response to a legitimate interest in working with contract processors who can support LCM Digital in the operation of LCM Digital services through the deployment of experts.

LCM Digital transmits the personal data of the LCM Digital client, including the fees to be paid, to Drees & Sommer SE, Obere Waldplätze 13, 70569 Stuttgart, Germany, which handles the payment of the fees.

LCM Digital transmits the LCM Digital client's Personal Data to CCT International Inc. BVI, Wickhoms Cay, Road Town, Tortola, British Virgin Islands, which LCM Digital assists with support services for the LCM Digital platform.

LCM Digital transmits the personal data of end users, including administrators, from the use of the platform functionalities in the app to the respective LCM Digital client, who has provided the end user or administrator with access to his client account, so that the LCM Digital client can further view, process or analyze the data created, processed or uploaded in the app during the use of the platform functionalities in the web application, as intended by the platform functionalities. The contact details of the respective LCM Digital client can be found in the imprint of the respective LCM Digital client, which you can access after logging in to the web application under the heading "Imprint".

LCM Digital does not pass on the personal data of LCM Digital clients, their administrators or end users to any other third parties, except the LCM Digital client or administrator or end user has instructed LCM Digital in writing to do so.  If LCM Digital commissions other companies to perform tasks under a contract processing agreement on behalf of LCM Digital and to transfer Personal Data for this purpose, these companies are obligated to protect the transferred Personal Data and to use it only for the purposes agreed in the respective contract processing agreements.

In cases where LCM Digital transfers Personal Data to countries outside the EU/EEA, it will only do so on the basis of adequate safeguards to ensure an adequate level of data protection, such as EU standard contractual clauses or certification under the so-called Privacy Shield.

5. What security measures are taken?

LCM Digital takes reasonable technical and organizational security measures to protect the Personal Information of LCM Digital customers, administrators, and end users from being unlawfully destroyed, lost, altered, or compromised by third parties.

6. Rights of LCM Digital customers, administrators and end users

If certain requirements are fulfilled, LCM Digital customers, administrators and end users have the following rights:

  • Right to information about their personal data processed by LCM Digital,
  • Right to rectification of their personal data,
  • Right to deletion of your personal data,
  • Right to limit the processing of your personal data,
  • Right to except to the processing of their personal data,
  • Right to receive their personal data in a structured, common and machine-readable format (right to data portability),
  • Right to revoke their consent to the use of their personal data with effect for the future,
  • Right not to be subject to a decision based solely on automated processing, including profiling.

We will not share this information without your consent.

Hence, the processing of the data entered into the contact form occurs exclusively based on your consent (Art. 6 Sect. 1 lit. a GDPR). You have the right to revoke at any time any consent you have already given us. To do so, all you are required to do is sent us an informal notification via e-mail. On this website, we have activated the IP anonymization function. As a result, your IP address will be abbreviated by Google within the member states of the European Union or in other states that have ratified the Convention on the European Economic Area prior to its transmission to the United States. The full IP address will be transmitted to one of Google’s servers in the United States and abbreviated there only in exceptional cases. Contract data processing

We have executed a contract data processing agreement with Google and are implementing the stringent provisions of the German data protection agencies to the fullest when using Google Analytics.

Demographic parameters provided by Google Analytics

This website uses the function “demographic parameters” provided by Google Analytics. It makes it possible to generate reports providing information on the age, gender and interests of website visitors. The sources of this information are interest-related advertising by Google as well as visitor data obtained from third party providers. This data cannot be allocated to a specific individual. You have the option to deactivate this function at any time by making pertinent settings changes for advertising in your Google account or you can generally prohibit the recording of your data by Google Analytics as explained in section “Objection to the recording of data.”
